
Case prioritisation has gained considerable judicial attention in recent years. It refers to the expedited disposal of certain cases based on their nature or the characteristics of the litigants. However, there has been no comprehensive effort to compile and examine the various mechanisms currently guiding case prioritisation. This paper presents a landscape review of case prioritisation practices in India by analysing case flow management rules, High Court rules, legislation, judicial decisions, and administrative orders of the courts. The paper critically evaluates existing practices and argues for a shift away from the current approach, which largely relies on case-type-based prioritisation. Instead, it advocates for a more data-driven, adaptive framework that considers factors such as case complexity, urgency, and the workload of individual courts.
